OGS to Merge with Brien Holden Vision Institute Foundation

The Global Board of Optometry Giving Sight announced today that it will merge its operations into the Brien Holden Vision Institute Foundation. The decision was based on a desire to ensure that by working more closely together, the entities could achieve more significant and sustained outcomes to benefit the millions of people who are needlessly blind or vision impaired simply because they can’t access an eye exam and glasses from a qualified optometrist.

“Support for public eye health has changed enormously since 2003 when Professor Brien Holden first established Optometry Giving Sight in partnership with the World Council of Optometry and the International Agency for the Prevention of Blindness,” said Dr. Juan Carlos Aragon, Chair of Optometry Giving Sight. “Optometry Giving Sight has done an incredible job over the past 14 years in mobilizing resources from the global optometric profession and industry to support more than 117 high impact eye and vision care projects in 39 countries around the world.

“Our goal is to ensure the campaign can continue to grow and develop. The Board feels this can be done most effectively as part of the Brien Holden Vision Institute Foundation.”

Dr. Aragon advised that all current Global Board members have been invited to continue to support the campaign as part of a newly formed Advisory Board; and that he will join the Board of the Brien Holden Vision Institute Foundation. All current agreements with Optometry Giving Sight project partners will continue and the Optometry Giving Sight brand will be maintained.

Clive Miller finished up as Optometry Giving Sight CEO in December 2017 and has since accepted the newly created role of Global Head of Philanthropy for the Foundation. All other Optometry Giving Sight staff will remain working in the merged organization.

Safilo Appoints Andrea Busato Commercial Head Latin America

SAFILO has appointed Andrea Busato Commercial Head of Latin America.

Andrea Busato joined SAFILO in 2012 as CFO for EMEA, bringing 15 years of experience in the Fashion Industry namely at Diesel and Salvatore Ferragamo, and in Consulting with Deloitte.

He was appointed Global Sales Operations Director in 2014, and then promoted in 2016 to SAFILO’s Global Leadership Team as Head of Global Sales Operations, reporting to the CEO.

In this capacity, Andrea has been leading a team of more than 400 people across the world, with responsibility for Customer Service, Sales Force Automation, the SMILE program, Trade Terms and the Order-to-Cash stream in the worldwide SAP implementation, as well as Sample Management and Special Stock Depletion Sales.

Andrea will be based in SAFILO’s Miami office, the Latin America HQ, as of February 1st, 2018.

Provincial Courts Differ on Online Eyeglass Sales

The Ontario Colleges of Opticians and the Ontario College of Optometrists jointly filed an application in December 2016, as is their right under Ontario legislation, to request the Court issue an order to Clearly to comply with Ontario’s Regulated Health Protection Act and the related Optician Act and Optometry Act. The case was heard in October 2017 and the court rendered its decision on January 11, 2018. The Ontario Supreme court ruled in favour of the Colleges of Opticianry and Optometry, ordering Clearly to comply with Ontario regulations.

British Columbia and Ontario Diverge
The judge noted that basis for the decision lay in the underlying purpose of Ontario’s regulated health professionals legislative framework. Unlike British Columbia, where legislation was changed in 2010 to reflect a purpose of consumer choice and enhanced competition, such is not the case in Ontario, where the framework of professional monopolies exists to deliver health care while protecting the interests of Ontario residents. The decision reads, “There is no justification for imposing the purpose of health professional legislation from British Columbia on those who reside in Ontario.”

“Dispensing” Not Defined in Quebec
A similar action taken by the Ordre des optométristes du Quebec v. Coastal Contacts Inc. ruled in favour of the company against the Ordre (College) in December 2014. What is the difference between the cases in Ontario and Quebec?

The Quebec case is distinguishable in the detailed definition of the practice of Optometry in Quebec’s code which includes the words; “sale and replacement of ophthalmic lenses.” The decision in the Quebec case is driven by the word “sale”. The law of British Columbia governed since it was determined that the sales contract between the company and the resident was substantially entered into in BC, and that the product was only “delivered” to a resident in Quebec.

Unlike in Ontario, where the “controlled act” of dispensing is broken into discrete defined steps, which does not include the actual sale of eyeglasses, there is no such equivalent in Quebec.

After a single month of wear, 85 percent of children said the lenses were easy to insert4. Children were found to have not changed their daily activities, and their wearing experiences were similar to those of children wearing a single-vision lens.
